HIPAA Notice of Privacy Practices

This notice describes how your medical information may be used and disclosed, and how you can access this information. Please review it carefully.

The covered entity under this notice is Jonathan Kim, PMHNP-BC, doing business as Umbrella Mental Health, a sole proprietor licensed in the State of California. Umbrella Mental Health is a trade name only. This practice is not a corporation, LLC, or partnership.

Legal obligations

Jonathan Kim, PMHNP-BC (doing business as Umbrella Mental Health) is required by federal law (HIPAA) to maintain the privacy of your protected health information (PHI). This notice describes the legal duties and privacy practices that apply, and those practices will be followed as described.

How your information may be used and disclosed

Treatment

Your health information is used to provide, coordinate, and manage your psychiatric care. This may include sharing information with other treating providers when appropriate — for example, communicating with your primary care physician about medications.

Payment

Your health information may be used and disclosed to bill your insurance company and process payment for services rendered. This includes submitting claims and verifying coverage.

Healthcare operations

Your information may be used for internal operations such as quality review and administrative purposes. These uses are always limited to what is necessary and permitted under HIPAA.

As required by law

Your health information will be disclosed when required to do so by federal, state, or local law — including mandatory reporting obligations for imminent danger to self or others.

Other uses

Any use or disclosure of your health information beyond the above requires your written authorization. Any authorization may be revoked at any time in writing, except where action has already been taken based on it.

Your rights

Right to access your records

You have the right to request a copy of your medical records. Requests must be made in writing and will be responded to within 30 days. A reasonable fee may apply for copies.

Right to request corrections

If you believe information in your records is incorrect or incomplete, you have the right to request a correction. Requests may be denied in certain circumstances, and any denial will be explained in writing.

Right to request restrictions

You may request limitations on how your health information is used or disclosed. Not every restriction request can be agreed to, but any agreed-upon restriction will be honored.

Right to an accounting of disclosures

You have the right to receive a list of disclosures made of your health information for purposes other than treatment, payment, or healthcare operations within the past six years.

Right to a paper copy of this notice

You may request a paper copy of this notice at any time, even if you previously agreed to receive it electronically.

Confidentiality of mental health records

California law provides additional protections for mental health records beyond standard HIPAA requirements. Psychotherapy notes are held to a higher standard of confidentiality and are not routinely shared even for treatment purposes without your explicit authorization.

Complaints

If you believe your privacy rights have been violated, you may file a complaint directly at info@umbrellamentalhealth.com, or with the U.S. Department of Health and Human Services, Office for Civil Rights. Filing a complaint will not result in any retaliation or adverse effect on your care.

Changes to this notice

This notice and the privacy practices described within it may be revised at any time. A revised notice will apply to all health information on file, including records created before the change. An updated notice will be posted on this website and made available at the time of your next appointment.
